Our online merchandise prices are the same as those in our retail stores. All prices are quoted in GBP/USD/EUR.

ELIGIBILITY TO PURCHASE PRODUCT

All products on the website are available for worldwide sale excluding perfume. Due to courier restrictions perfume can only be posted within the UK.

GIFT WRAPPING 

Gift Wrapping is available on all items in the Gift Ideas. The standard charge for gift wrapping is £2.99. If gift wrapping is not available at the checkout and you wish to enquire about this service, contact our customer service team to arrange this option, email customerservices@hervia.com

SPECIAL PROMOTIONS

Occasionally, we may offer promotions which require a code. This promotion code should be entered in the appropriate place as you check out and purchase a product. The offer will be reflected in your total. Exclusions apply to and not limited to Perfumes, Jewellery, Sunglasses, Maison Margiela Tabi boots, Comme des Garçons PLAY,Comme des Garçons WALLET, Launches and Rick Owens Classics. The following brands are currently excluded from all promotions: COMME des GARÇONS Play x Converse, Rick Owens, Rick Owens DRKSHDW. 

Free Worldwide Shipping promotions are subject to a minimum spend of 25 GBP during the promotional period. Ordinarily Free Worldwide shipping is applied after spending over 200 GBP.

CANCELLATION

All cancellations must be made within the first hour of making a purchase. Cancellations may be subject to credit card fees.

RETURNS - UK/ EUROPE

If you live in the United Kingdom or another European Union country, you have a legal right to cancel your order after you have received and inspected the goods. Please note that in the case of accessories and jewellery, “inspect” means examine, and does not permit you to wear or use the items. Perfume and body products cannot be returned opened for hygiene reasons. All pierced earrings, underwear and swimwear are strictly non-returnable for hygiene reasons.

If you do not return the goods within 14 calendar days of your cancellation notice, we may chose to recover the goods from you, and if we do so, to charge you for the cost of doing so. If, despite sending a cancellation notice, you do not return the goods within 14 days of your notice of cancellation, you will be deemed to have accepted the goods, at which point a new purchase contract will be made, and if we have already granted a refund, you will be re-charged for your order at the price set out on the web site. This does not affect your statutory rights.

All items ordered from Hervia.com will be supplied with a white Hervia security tag. This must remain attached in order for any item to be returned, if this has been removed then the return will not be accepted.

RETURNS - REST OF THE WORLD (inc USA, Canada, Australia Japan, China, Taiwan & Korea)

The EU cancellation rights set out above do not apply to customers living outside of the EU. Non EU customers may return any unwanted products within 14 calendar days of receipt, providing it is in it's original condition and packaging. You may return a product(s) for an exchange or receive funds into your original method of payment. 

After 14 days we will no longer accept returned items. Perfume and body products cannot be returned. All earrings for hygiene reasons are strictly non-returnable. We do not refund shipping charges.

Returns Do’s and Don’ts – All Countries

Please see the "Return an item" page for step-by-step instructions on how to go about returning goods. Please note that when posting return goods from outside the UK, you are responsible for paying any customs levies or duties on those goods payable either on exit from your country or on entry to the UK. If the goods which you have sent back to us are kept in customs because you have not paid those levies or duties, we will not have received them. Because it is your responsibility to pay all customs duties, legally you will not have returned the goods to us / kept them in your care, and so will not be entitled to any refund / exchange. Where you and we agree that an exchange of goods is appropriate, we reserve the right to charge you our costs for posting the exchange goods to you. Similarly, where the goods are returned to us as undelivered by your postal service, and we agree to re-send them to you, you will have to pay the additional postage costs.

If you fail to return packaging which is an integral part of the overall product (for example branded jewellery pouches or the dust-proof bags which protect handbags and Hervia branded white tags attached to the said item) then you will not have returned all of the goods, and we reserve the right to recover the cost of replacement from you and where there is evidence of dishonesty, to refer the matter to the police.

Where goods are returned in a damaged, worn or dirty condition, which indicates that they have been worn or used after you have had a reasonable chance to inspect them on receipt, we will consider you to be in breach of your legal duty to take reasonable care of the goods and reserve the right to recover appropriate sums from you.

Where you return goods to us which are not the goods which we dispatched to you (which we can easily check), you will not have returned the goods, and accordingly will be deemed to have accepted the original goods which we sent you. We will notify the police where there is any attempt at fraud or dishonesty (for example where lower value items are returned), and will actively pursue all such cases through the courts. We will also actively fight any fraudulent claim-backs made through your credit card company.

If you do not comply with your obligations above, we may make a reasonable charge to cover any costs that we incur (for example in respect of wasted collection journeys or for goods that you have wrongly used, damaged, dirtied, or lost).

Hervia.com reserves the right to amend this returns policy without notice under advice from Government appointed agencies.

DAMAGED or MISSING GOODS

If you should receive an item that is not in perfect condition/was damaged in shipping or is missing from your parcel, please notify us by emailing customerservices@hervia.com within 48 hours. If you fail to make contact with us regarding these issues within 48 hours we will be unable to investigate this further for you. 

SHIPPING

All merchandise is shipped by UK Courier (this will not be affected by Postal Strikes) or for Overseas Orders by INTERNATIONAL airmail. Both methods will require a signature on receipt. Please allow up to 3 business days for UK orders and up to 10 business days for all international orders. The Shipping rate is per order and will not change however many items you order. At our discretion, additional charges may apply for bulky, heavy or multiple items purchased on our online store. Some free shipping promotions are subject to a minimum spend. 

You (the receiver) are responsible for providing the correct address and contact details for your order to be delivered safely. If you do not receive your order due to you giving incorrect details or if any charges occur due to the above (item is destroyed by the courier or the customs agency, shipping charges for the return of the parcel or any other additional charges) it is your responsibility and therefore any costs will be deducted from your refund.

CLICK AND COLLECT 

All click and collect orders must be placed on the website by selecting the click and collect delivery option at the checkout. Once you have placed your order, please allow 1-3 working days for the item to be available for collection. Once your order is ready for collection, you will receive an email. Valid ID must be shown to collect the order. All click and collect orders must be picked up within 7 days of receiving the collection email. Failure to pick up your order will result in a cancellation.

IMPORT DUTIES

You are responsible for all the appropriate Import,VAT and Customs Duties. 

FRAUD

In order to protect against fraud we only are able to ship items to the billing address of the credit card holder or to another address at our discretion. We do check the address you give on your order before shipment. 

GENERAL

If the courts decide that any part or wording in these terms of sale is illegal, invalid or unenforceable then that part or wording shall be deleted from the agreement and rest of the terms of sale shall remain in force. All contracts formed, sales made, and legal disputes arising through the use this website shall be governed by English law. The English courts shall have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these terms of sale or use of the website. These terms and conditions shall apply to all internet sales made by Hervia.com, and by placing an order with Hervia.com you are accepting these terms and conditions.

PROMOTIONAL CODES

Promotional codes are sometimes offered to customers as seasonal offers. Only one promotional code can be used in conjunction with any one order at a time. Promotional offers like discount codes and Free Shipping offers, are subject to change without notice.  THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS. If you have any doubts about your statutory rights please contact your local Trading Standards department or Citizens Advice Bureau.
